Any Skill you add to your deck arrives upgraded. Card rewards show the upgraded version, the merchant's Skills are upgraded on his shelf, and a Skill added by an event or transform is upgraded as it enters. Skills you already own are not touched. The relic stops being offered from the Act 3 treasure chest onward, floor 41 solo or 38 in multiplayer.

When to take Toxic Egg
Take it in Act 1 or 2 for a Skill-heavy character, then spend your Rest Site upgrades on Attacks and Powers instead. By Act 3 it is barely worth a chest slot and never worth the Gold.
